Who's in charge of interlock rules in Kansas?

Regulation of the state's interlock industry falls to the Kansas Highway Patrol working alongside the Kansas Department of Revenue. An interlock itself is a small breath tester that gets wired into your car. Blow a clean sample or the engine won't start.

Under Kansas law, whatever device you use needs Highway Patrol approval. Approvals last 3 years, and the Highway Patrol publishes a list of approved manufacturers. Check that list before you book, since only a device from it will satisfy your restriction.

Applying for a restricted license

The Department of Revenue won't issue a valid DUI restricted license until you've completed its Compliance Review Process. Think of it as the state's way of confirming your device and paperwork are all in order. A restricted license puts you back on the road, but only in a car with an interlock installed.

There's a $100 application fee to switch your suspension over to restricted interlock status. Getting the device installed ahead of time means you're ready to go the moment the state clears you to get back behind the wheel.

How long the interlock stays on

Once your suspension under Kansas's test refusal and failure rules is behind you, the state limits you to driving an interlock-equipped vehicle for 180 days. Certain earlier convictions or license actions on your state record bump that up to 1 year.

The restriction doesn't just end when a date passes. To complete the program, the 90 days leading up to your reinstatement application must show no more than 2 standard violations and nothing serious. Blow a failed test with a reading of 0.08 or above and that's called a high BrAC. BrAC means breath alcohol level, and it works against you.

What an interlock costs in Kansas

The device and its upkeep are on you to pay for. The agreement you sign at the service center can cover costs for putting the device in, monthly servicing, and taking it back out.

MADD's national averages put installation at $70–$150 and monthly service at $60–$80. On those numbers, a 6-month restriction totals roughly $430 to $630. For 12 months, it's roughly $790 to $1,110. Prices vary by company, so the quote you receive is your real price. One call links you to a Kansas installer who will provide that quote.

Driving for work

Your employer's vehicle can be driven without an interlock during normal business activities, so long as you don't own or control the vehicle or the business. The exception leaves out cars you or your family own.

Why is tampering such a serious risk?

Under Kansas law, nobody who isn't certified may try to disable, disconnect or get around an interlock. If you're convicted of breaking your interlock restrictions, another 1 year of suspension gets added to your driving privileges. So if anything goes wrong with the device, that's a matter for your service center.
